On the basis of the Slovene Environmental Protection Act similar acts and EU directives on packaging and waste packaging, the
Slovene government passed regulations for handling waste packaging
which are intended to prevent waste packaging and encourage the reuse of
packaging and measures for recycling and processing waste packaging.
The key element of the regulations is the "polluters pay" principal: producers,
importers, and packaging companies, and, in certain cases, stores, are
required to cover the costs of their complete handling of waste packaging
that is not municipal waste and the costs of collecting and processing waste
packaging that is municipal waste. They are required to pay the authorized
service provider (in Slovenia SLOPAK) the costs of the service, which are
proportionate to the quantities of waste a company has produced.
Persons governed by these regulations must sign an agreement with the service
provider (in Slovenia SLOPAK) authorized for handling waste packaging.
According to these regulations, packaging that is not communal waste can be
collected by the manufacturer, importer, packager, or store itself, if it is
properly registered with the Ministry for the Environment. In this case,
costs are paid to the service provider only for packaging that ends up in
the service provider's waste collection system.
Manufacturers, freight forwarders, packagers, or stores must accept
transport or collective packaging directly following the supply of goods or
the next supply of goods free of charge if the end user wishes to return it.
Companies that do not exceed the prescribed
quantities are not required to take the prescribed measures for handling
waste packaging.
